"mornings on 2" begins right now. well, good morning to you. welcome to "mornings on 2." i'm dave clark. >> good morning. i'm tori campbell. it's wednesday, september 29th. it was a war of words for the first debate. jerry brown and meg whitman let us see their different viewpoints as they clashed on issues. claudine wong has more on last night's spirited debate. >> reporter: both candidates are claiming victory. both candidates went on the attack. both candidates tried to convince voters that they can handle this job. now, this debate at uc davis was the first of three debates.

there's another one right around the corner. you can bet this is being picked apart. california certainly facing a lot of controversial issues from immigration to the death penalty to the budget crisis. all of that was on the table yesterday. whitman apologized for forgetting to vote in the past election, saying no one is more embarrassed than her. she did not apologize for putting $119 million of her own money in this campaign. >> the labor unions and jerry brown have been joined at the hip for 40 years. my view is putting jerry brown in charge of putting jerry brown -- of the unions is like putting count dracula in charge of the blood bank. >> reporter: people we spoke with say whitman appeared to be stiff and brown is more

relaxed, cracks more jokes. but he did try to prove to voters last night. he's not just a career politician, that he can still be revent at the age of 72 and more than four decades in government. >> i've been in the kitchen. i can take the heat. i have the know-how, the spine, the intelligence, the wisdom and at my age, to do what's right. >> reporter: we talked to some people. most have already said they've made up their minds. one in five are still undecided. there are two more debates scheduled. the next one is in fresno on saturday. we've been gauging the debate and we'll tell you what some people are saying about possible memorable moments. we'll have that for you coming up later on "mornings on 2." claudine wong, ktvu channel 2 news. >> thank you, claudine. it is 7:03. we just got a phone call from

tmz.com alerting us to a news conference this morning where the website says a former housekeeper for meg whitman will make "controversial and explosive allegations about her former employer." the housekeeper is represented by gloria allred, tmz says. the news conference is at 11:00 this morning. you can follow all of the latest election news and get extended excerpts at the website. there will be an 11th-hour appeal after a federal judge blocked the execution of condemned killer, albert greenwood brown. the execution was scheduled for last night. but last night the judge cancelled the execution saying he needed more time to determine if california's new lethal procedures amount to cruel and unusual punishment.

the judge's decision came 27 hours after the 9th circuit court of appeals got involved in the case. >> the 9th circuit court of appeals is concerned there's enough time for this. >> brown has been sentenced to die for raping and strangling a 15-year-old girl in riverside 30 years ago. it would be came's first execution in almost five years. 7:05. san francisco police are looking for a man in connection with rape and robbery. police say 27-year-old damir shalakd is on patrol and should be considered dangerous. he has a tattoo right under his right eye. this happened at the potrero hill housing development. police think he may be using

public transportation to get around. we're planning to get an update on this man from police at 7:0. in oakland, a police search is underway for a second suspect after a man was shot outside highland hospital. the shooting happened shortly after 5:00 p.m. yesterday on east 33rd street near the highland hospital entrance. the victim was critically wounded. one suspect has already been arrested but police are still looking for a second gunman. this morning we talked to one patient who says he does not think the hospital has enough security and he does not feel safe. >> they let anybody come in. it's a county hospital. they don't really got the right staff. >> ktvu has been told that yesterday's violence is connected to an earlier shooting at macarthur boulevard, where two people were wounded. 7:06. well, the federal government said no, they rejected california's request for disaster aid for the san bruno

pipeline explosion victims. fema has determined the massive recovery effort has not overwhelmed state and local agencies. that requirement is necessary in order to qualify for federal aid. so that decision means california loses out on millions of dollars in disaster relief money to cover the costs of that disaster. the governor plans to fight fema's decision. in the meantime, the disastrous pipeline explosion and fire claimed another life. doctors at uc san francisco removed jimmy nranco from life support. he was critically injured when the pipeline exploded 200 feet from his house. he's now the eighth person to die as a result of the disaster three weeks ago. in just about an hour, a large group will protest about the state's overdue budget.

they are gathering in fremont. these are live pictures here. a program could be at risk if a budget isn't reached. today the center will be closed as the march happens along fremont. that will be -- we'll have a live report shortly. the giants are in a tight race for the nationally league, two games up with five games to go. the team's dynamic pricing, they adjust the prices several times a week depending upon how often the tickets are in demand. lately, the demand has been high. prices for a ticket this friday, when the giants play

by republicans, pension reform and school funding. governor schwarzenegger met a legislative deadline to sign 21 new bills into law. one bill allows state prisons to release severely ill inmates on parole. other bills signed by the governor include one to make it illegal for motorcycle owners to remove emission control devices to make their bikes louder and the other for the importation of kangaroo body parts to make apparel. a san jose woman has been arrested for the seventh time in three months accused of vandalizing cars. her name is nancy chi ni. she was arrested and since

she's been arrested before she's being held in $2 billion bail. authorities say ni has vandal identified a dozen cars -- vandalized a dozen cars in alameda. there was a gas leak that happened around 2:15 in the afternoon at seaview parkway near bay farm elementary school. alameda fire officials say at&t contractors accidentally ruptured a high-pressure gasline. residents received automated phone calls telling them to shelter in place. but the pg&e advised people at least in 12 houses to evacuate for good. the gas leak was capped. luckily, no one was hurt. 7:19. the santa clara valley water district is lifting its mandatory water conservation.

it's asking customers to maintain their usage. the district says local reservoirs are currently above the 20-year average because of the heavy rains. district board members warn there could be a return to mandatory conservation if there is not enough rain in the coming season. more mosquitoes and a bird in the east bay have tested positive for west nile virus. contra costa vector control experts say the latest infected mosquitoes were found in a trap near lone tree way and deer valley road in antioch. the dead bird was discovered near jordan lane in oakly. they are conducting more informations and applying insecticide in the area. they have played for mosquitoes in eastern parts of the county several times this year. officials are warning residents that mosquitoes thrive in standing water.

it is 7:30. we have new information about a rape in san francisco and the search for the suspect. ktvu's jade hernandez just spoke with police minutes ago. jade joins us now live. what were you able to find out? >> well, we were able to find out that this man stole $1,000 from his victim and may still be here in san francisco. he has a very distinctive tattoo. the letters "sf" tattooed under his right eye. he's considered very dangerous. he may be using public transportation because he doesn't have a car to get around here in the city. i want you to take a look at his picture. this is his picture this morning. the man police are looking for also has tattoos on his neck. his name is damir. he's 5'8" 170 pounds with brown hair. he last seen walking around without a shirt and jeans. he's on parole from santa rosa. police are searching for this

25-year-old because he's being tied to a brutal rape, robbery and beating yesterday. his family member who he's saying with heard the victim scream and found her. >> he's dangerous. it was a brutal attack and sexual assault. the victim, 45 years old. really doesn't know the person. >> reporter: the suspect has about not been arrested and is being considered dangerous. if you do see him, police are urging you to call 911. and to stay away from him. they believe he may be using drugs. reporting live in front of headquarters, back to you. >> thank you. a large budget protest is about to start in just about a half hour from right now and this one could affect your commute. ktvu's kraig debro is in fremont where protesters are already gathering and getting ready to take to the streets.

good morning,. >> reporter: good morning. about an hour ago there was just a handful of people. take a look at the people in the parking lot right now. this looks like a protest that's about to get underway. i was just told they were to start at 8:00 and get on a b.a.r.t. train. the center's locations, 41 of them, are closing today, without the budget agreement, the agreement that the center needs to stay open. >> we're considering this an emergency and we're doing this for one day hoping this is not the norm for our families. >> reporter: that's why the center says it's worth the time 57 energy to intentionally shut down for a day, closure for a day.

how has the department changed? chief batts is in the studio with us. thanks for being here. >> aappreciate you allowing me to come. it will be a year the end of the -- of october. >> i was with you when you took over in long beach and now you are here. it's been an eventful year, a lot of things have happened. as you size it up, just as a capsule, how would you size up a year in oakland. >> i think oakland is kind of interesting. where i came from there's ebbs and flows. oakland is on all of the time. i think we've improved as an organization. crime is down, the murder rate is down 22%. we had two major crowd control incident, one that took up the freeways, the other end at the end of the johannes mehserle trial. we did an excellent job. we captured some high-profile

criminals here. wewe should be seen as a professional organization. >> i was looking over the crime report. there's one area that spiked. residential burglaries. how do you account for that? >> well, i did a poor job of messaging that we were shifting workload from officers coming out to locations to officers -- to being able -- to citizens being able to go on computers. it was poor messaging for a very smart thing to do. low crime has gone up. we're concentrating on improvesing that. >> there were stories like the one yesterday, when the 6-year- old was shot, sleeping in her

bed. what are your comments on that? >> one of the reasons i came here, was the impact of people. there was a girl i read about shaniese davis, she was laying in her bed and shot. i'm outraged by this. we will track down the perpetrators. but we're trying to move the family so they are in -- moved into safety. i think the number of shootings and the violent crime in our city has reduced. >> i know we don't have a whole lot of time. i know your hope is that some of the officers who have been laid off, would you like to bring them back. you are trying to work on a number of things. have you a lot to do, a lot on your plate, but still you made time to be here with us and to help celebrate your first year as police chief in oakland.

[ no audio ] >> reporter: there are dozens of people out here, staff members with the child development center. they have 41 locations throughout the bay area. you've got parents of the children that go to the centers here and they will be leaving here in just a moment. people here at the complex are gonna be rallying for the nonprofit. but there are other locations across the state. the agreement that the center needs to stay open is a budget agreement between the governor and legislature. right now that's been going on for more than 90 days. that's a record. each day the budget impasse is in effect, that's money that the center doesn't get to keep the kids in the center. since the start of the fiscal year, july 1st, they've not received any checks from the state. it's not just the staff and parents that are out here. their children are getting ready to make a statement as well. >> it's very important. there's really nothing else we can take our kids to.

he's 4 years old, if it weren't for this center he wouldn't be learning -- i can only teach him so much but i'm not a professional. >> the center has a lot of people working and -- >> bilingual. >> yes, bilingual, teaching two languages at the same time. >> reporter: now, the children are here, they serve children from infancy, especially if they have school, they said they are gonna shut down the center today because they felt it was worse not having the kids in the center like they normally would on any day. they realize that's very important but they also realize if they don't do this today, there may not be a center to go to in the future. it's not just this center. every other center is going lean in the state. that's 700 centers and employing 30,000 people. without these centers in place, you are talking about alternatives that parents would have to make, maybe one quits

their job, stays home with the kids. maybe the kids don't go to a center. and then there's 30,000 people who would have to find other jocks. in the past, childhood development centers have been spared acts. they've put child care in the crosshairs of the budget acts because of the $19 billion budget hole. what they are doing to stay open is getting lines of credits from bank and relying on reserves. they say if they don't get the budget agreement signed by november 15th and they have no more money coming in, they are facing a temporary shutdown. they will be head thing to -- heading to downtown oakland. the march should be getting underway any time now. reporting live in fremont, kraig debro, ktvu channel 2 news. >> kraig, i'm gonna take it from here. just to talk about the traffic

amount to cruel and unusual punishment. the judge's decision came 2 hours after the circuit court of appeals stepped in. >> what the 9th circuit was clearly concerned about was it if there was enough time to conduct a meaningful review. >> later on today, the governor's office will ask a federal appeals court to lift the stay and allow the execution to take place. brown has been sentenced to die for raping and strainingle -- strangling a 15-year-old girl 30 years ago. it is 8:08. the san francisco giants' success on the field is leading to ticket price increases that are jumping00% -- 300%. the giants are in a very tight race with the national league west. two games -- lately, as you can imagine, demand is very high

he's looking forward to resuming his schedule soon. the federal government has rejected california's request for disaster aid for the san bruno pipeline explosion victims. fema has determined the massive recovery effort has not overwhelmed state and local agencies. that requirement is necessary in order to qualify for federal aid. the decision means california loses out on millions of millions of dollars in disaster relief money to cover the costs of the calamity. the governor plans to fight fema's decision. the disastrous pipeline explosion and fire has claimed another life. doctors at uc san francisco removed james franco from life support monday morning. the 58-year-old san bruno man was critically injured when the pipeline exploded just 200 feet from his home. he's the eighth person to die as a result of the disaster three weeks ago. 8:18. this is the 91st day without a

state budget. governor schwarzenegger and the legislative leaders cancelled their meeting yesterday. still unresolved issues include a business tax break that republicans are pushing, pension reform and school funding. even while the budget impasse continue, the governor met a deadline to sign 21 new bills into law. one bill allows state prisons to release severely ill inmates on medical parole. the governor says right now, california wastes millions of dollars guarding physically incapacitated inmates who are in comas or similar conditions who pose no threat to public safety. other bills signed by the governor to make it illegal for motorcycle owners to remove the emission control devices to make their bikes lauder. another bill that allows the importation of kangaroo body parts i would are used to make

soccer shoes and other apparel. the governor vetoed 18 bills. a san jose woman has been arrested in the -- for the seventh time for vandalizing cars. she was arrested in the parking lot of the valley fair mall. she's been in trouble before. she's being held in lieu of $2 million bail. we talked to police a few moments ago about what they believe she did to the cars. >> i don't know the exact item that was used. however, i do understand that it was a sharp metal-type october that was used to -- object that was used to vandalize. i believe she was scratching vehicles. >> authorities say she's vandalized a dozen cars in santa clara county and alameda county. no word on a motive at this time. 8:20. there is a bay area county that's lifting mandatory water restrictions but that good news comes with a very important

the santa clara valley wather district is lifting its mandatory water conservation. it's asking customers to maintain water use on a voluntary basis. the district says the local reservoirs are above the 20- year average because of the heavy rains earlier this year. district board members washed there could be a return to mandatory conservation if there's not enough rain in the coming season. an east bay store that's part of the world's largest retailer will be expanding. the antioch city council approved plans to adding a grocery store to the walmart store on lone tree way. several city council medicals say they didn't necessarily support the expansion but they didn't block it. for six years, walmart has been trying to add a grocery store, a deli and a bakery to that location. critics say the expansion will hurt other local businesses. that would also add to -- local businesses, that would also add

to crime in the city. the 7-11 facility will close and 90 employees will lose their jobs. the company will transfer the employees to other locations. those who don't move to other locations will be given some help in finding new jobs as well as severance pay. talk about a cringe-worthy moment. it's causing a lot of buzz on twitter this morning after the host of australia's top model tv show accidentally announced the wrong winner on live tv and then took it back. >> i don't know what to say. this is -- it's a complete accident. it's amanda. i'm so sorry. >> the stunned actual winner, the youngly day in the red dress, will be getting $25,000 to appear in a levis add and $25,000 in cash prize. the show's producers felt so

year-old malvin bell of oakland. he's been booked into jail on assault with a deadly weapon charges. again, now police say three suspects are on the loose, not one, as first thought. this morning we talked to one patient who says he does not think the hospital has enough security. >> they let anybody come in. it's a county hospital. they don't really got the right staff. >> ktvu news has been told that yesterday's violence is connected to an earlier shooting at 89th avenue and macarthur boulevard where two people were would wounded. in the meantime, oakland police chief anthony bats says he's outraged by a shooting that injured a 6-year-old girl while she slept in her home. leslie ramirez underwent surgery yesterday to remove a bullet that went through her arm and into her chest. chief batts paid the girl a special visit and dropped off a teddy bear. family members believe leslie's older brother was the target of the intended attack.

$5,000 reward is being offered in this case. a large group of daycare workers, parents and students set off on a march in fremont protesting the state's overdue budget. right now they are making their way to the fremont b.a.r.t. station. the group works for kadango childhood development centers which could be at risk if a budget agreement is not reached by moisture 15th. today, the centers will be closed while the workers, parents and students march along mission boulevard in from mont. that will be followed by a noontime rally in oakland. kraig debro is with them tracking them along. he will have a live report newspaper. very soon if you are a smoker in contra costa county, you may not be able to light up even if your own -- in your own house. county supervisors passed a tough, new anti-smoking law that takes effect july 1st. it applies to new housing in

unincorporated parts of contra costa county. this includes marijuana smoking as well. it will be illegal to smoke on patios and bal row coy -- balconies. the board of supervisors passed the measure i would would affect big retailers like safeway and costco. walgreens unsuccessfully challenged the law in 2008, arguing that the exemption for larger stores made the bill unconstitutional. california's budget crisis has led to a been shell for uc -- bombshell for uc berkeley's sports program. because of budget cats, cal has eliminated baseball, men's and women's gymnastics and women's la crosse. the drastic changes will begin at the end of the school year.

people who are clients at the center. they are watching to the -- to the b.a.r.t. station. they are out here because the legislature has not been able to reach an agreement on the budget. they are angry because they need the agreement in order for the child care centers to get money. right now that's costing kadango $120 a day. it's not just kadango, there are child care centers all over the date. they employ 30,000 people. kadango has been surviving on lines of credits from banks and lines of reserve and they can only last until the 15th of november before they have to think about a shutdown. >> we consider this an emergency. so we're doing this for one

day. >> christina adams, a worker at the facility, is addressing the issue of why are you taking kids out of school to show that you need the money to keep them in school. she says if they don't do it now, they -- he there may not be a child care center in the future. right now, the marchers -- we're at the end of the marchers. off in the distance, now that we say that, there is a whole group of marchers there. you have another, i would say 100 people down there. this promises to be a long day for these people. they are gonna march to the b.a.r.t. station and take a b.a.r.t. train to downtown oakland where they will hold a rally in front of the station. back to you. explosive new allegations could soon take center stage in the race for governor. we'll hear more about the charges that meg whitman could
